1. Agreement
By accessing lemautomator.work ("the Site") or engaging the services of Lemuel Duyag ("we", "I", "Lem Automator"), you agree to these terms. If you don't agree, please don't use the Site or engage our services.
2. About our services
Lem Automator provides custom automation consulting and implementation — including but not limited to workflows in n8n, Make.com, Zapier, GoHighLevel, AI chatbots, voice agents, RAG systems, and related integrations. Specific deliverables, timelines, and prices are agreed in writing per project.
3. Project agreements
- Each engagement begins with a free 30‑minute audit call.
- Once scope is agreed, a written proposal is shared. Work begins after the proposal is approved (and a deposit is paid, where applicable).
- Changes to scope after sign‑off may incur additional fees, agreed in advance.
4. Payments
- Most projects are fixed‑fee. Retainers are also available.
- Invoices are typically split into a deposit and a final payment, unless otherwise agreed.
- Late payments may incur reasonable interest in line with applicable law.
- Refunds are not provided for completed work, but disputes are handled fairly and on a case‑by‑case basis.
5. Intellectual property
- On full payment, the client receives ownership of bespoke code, configurations, and workflows produced for them.
- Pre‑existing tools, libraries, frameworks, and templates remain ours and are licensed to you on a non‑exclusive basis for the project.
- We may reference completed projects in a portfolio or case study unless you ask us not to in writing.
6. Confidentiality
Any non‑public information you share with us is treated as confidential and not disclosed to third parties except as needed to deliver the project (e.g., approved subcontractors) or as required by law. You agree to similarly protect any confidential information we share with you.
7. Acceptable use of the Site
You agree not to:
- Use the Site to break the law or harm others.
- Attempt to disrupt, hack, or reverse‑engineer the Site.
- Scrape large amounts of content without permission.
- Submit false or misleading information through any form on the Site.
8. Third‑party services
The Site links to and integrates with third‑party services (e.g., Google Calendar, Netlify, social platforms). We are not responsible for the content or availability of those services — they have their own terms.
9. No warranties
The Site is provided "as is" without warranties of any kind. While we make every effort to keep it accurate and online, we don't guarantee uninterrupted access, error‑free content, or fitness for any particular purpose.
For contracted services, specific warranties (uptime, support response, etc.) are defined in each project agreement.
10. Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or relating to your use of the Site is limited to the amount you've paid us in the 12 months preceding the claim, or USD $100 — whichever is higher. We're not liable for indirect, incidental, or consequential damages.
11. Indemnification
You agree to indemnify and hold us harmless from any claim arising from your misuse of the Site or breach of these terms.
12. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you've breached these terms. For paid engagements, termination clauses are defined in each project agreement.
13. Governing law
These terms are governed by the laws of the Republic of the Philippines. Disputes will first be addressed informally; if unresolved, they will be handled by the courts of Mandaue City, Cebu, Philippines.
14. Changes to these terms
We may update these terms occasionally. The "Last updated" date at the top reflects any change. Continued use of the Site after a change means you accept the new terms.
